Collection of and Study on the Public System and its Application for Protection of Cultural Heritage in European Countries: Germany

In fiscal year 2001, the Center conducted investigation in Germany, especially in Hessen and Nordrheinwestfaren, that have advanced public system for the protection of cultural property. The investigation included interviews to the officers and specialists in these states who are involved in the protection of cultural property, visit to the historic buildings, historic towns and archaeological sites. Besides, the Center collected legislative texts for protection of cultural property and documents concerning public system in Japan and Germany.
Germany is federal nation and the states are highly independent, so it has few federal laws for protection of cultural property except for prohibiting illegal traffic of cultural property. Each state establishes the laws by itself, however, these laws are basically similar to each other. As for the listing system, there are no system for movable cultural property like museum collections, the system is for immovable cultural property (buildings or archaeological sites, etc). When the municipalities lists a building as cultural property, acceptance of the owner of the building is not needed. If the owner of a listed building wants to make some modification to the property, permission of the construction section or cultural property section of municipalities are necessary. For the cost of restoration work or renovation for improving the usability of historic buildings, the municipalities provide tax deduction system, and the system is effective for the protection of the buildings in Hessen and Nordrhein-westfaren.
In Idstein, the mission members were interviewed on a local newspaper and introduced Japanese system for protection of cultural property at that time. |
